Q.주민등록을 구비할 수 없는 외국인 갑(甲)이나 재외동포 을(乙)은 주택임대차보호법의 보호를 받을 수 없나요?

귀하의 질의에 대한 검토의견은 다음과 같습니다. 

○ 외국인이 90일 이상 체류하게 되는 경우에는 출입국관리법에 따라 체류지 신고를 포함한 외국인등록을 하여야 하는데(동법 제31조), 외국인등록 및 체류지 변경신고는 주민등록 및 전입신고에 갈음하므로 외국인등록신고를 대항요건으로 보아 주택임대차보호법의 적용을 받을 수 있습니다. 

○ 재외동포(재외국민과 외국국적동포)의 국내거소신고는. 재외동포의 출입국과 법적 지위에 관한 법률 제9조에 따라 거래관계 등에 있어서 주민등록을 대신하므로, 

거소신고를 임차주택 소재지 지번으로 하였다면 전입신고와 동일하게 보호받을 수 있습니다.

Q. Is it possible for foreign lessors or overseas Korean lessees who don’t have the resident registration to be protected by Housing Lease Protection Act?  

A. Thank you for your inquiry.
This is the director general office of legal counsel under the Ministry of Justice.
Here is the answer to your question.

○ In accordance with Article 31 of Immigration Control Act, foreigners who stay for more than 90 days have to register as aliens and report their temporary place of residence. An alien registration and a report of the change of the temporary place of residence are substituted for a resident registration and a moving-in report respectively. Therefore, foreigners who have registered as aliens are subjected to Housing Lease Protection Act.  

○ In the case of overseas Koreans(both those living abroad and those with foreign citizenship), a report of the place of residence in the country can be substituted for a resident registration under Article 9 of Act on Immigration and Legal Status of Overseas Koreans. And, because reporting the temporary place of residence house is regarded as a moving-in report, if you report it with the address of the rented house, you can be protected by the law.
